What types of disability benefits are
available to individuals in Las Vegas?

The Social Security Administration (SSA) offers two disability benefits programs, Social Security Disability Insurance (SSDI), and Supplemental Security Income (SSI).

SSDI is available to disabled individuals between the ages of 18 and 65, regardless of their financial resources. Applicants must have paid into the Social Security system through income tax deductions, however, and have acquired a certain number of work credits, based on their age.

SSI is only available to disabled individuals who are 65 or older or blind and who demonstrate financial need. These benefits are means tested which means an applicant’s income and financial resources cannot exceed a certain threshold.Whether you are seeking SSDI or SSI, obtaining these vital benefits is difficult — nearly two-thirds of initial claims are denied for the following reasons:

How do I obtain disability benefits in Las Vegas?

An application for disability benefits can be submitted to the SSA field office in Las Vegas in person, by phone or online. The application process is complicated, however, and you must provide medical evidence that supports your claim. What Social Security Disability Benefits Are Available?

Social Security Disability payments are available through Social Security Disability Insurance and Supplemental Security Income. These are two separate programs that are funded by different means, and those who meet the qualifying criteria can receive benefits from both programs at the same time. Whether you qualify depends on factors such as the presence of a disability, your work history, and your earnings history. A disability benefits attorney can review your case and help you determine which program or programs are a fit for your situation and what evidence and documentation to include in your claim to increase your chances of approval.

Who Qualifies for Social Security Disability?

The eligibility criteria to qualify for disability benefits depend on the specific program. Social Security Disability Insurance requires that the applicant meet the Social Security Administration’s definition of disability and have earned enough work credits in their lifetime to qualify under the insurance program. Those applying for Supplemental Security Income benefits don’t have to meet any work history requirements, but they do need to meet financial requirements. This includes having a limited income and limited financial resources.

What Is the Social Security Administration’s Definition of Disability?

The Social Security Administration defines disability as having a medical condition, which can be either a physical or mental impairment, that keeps you from being able to work. The condition must also be expected to last for at least a year, unless it will result in death. To make this determination, the claims examiner will review your medical records, statements from your health care providers, and other documentation to determine the severity of the condition and how it impacts your employment. If you meet all of these criteria and you are unable to continue your previous work or adjust to new work, you can qualify as disabled for benefits.

How Long Do You Have to Wait to Apply for Social Security Disability?

You should start the process of applying for Social Security Disability benefits as soon as a doctor confirms that you have a medical condition that will keep you from being able to work. Keep in mind that Social Security doesn’t offer benefits for short-term disability, so your doctor will also need to confirm that your condition has lasted or is expected to last for at least 12 months or that it is likely to result in death. The review process can take several months, so filing early can help you get your benefits as soon as possible.

What Are the Most Common Denial Reasons?

Social Security Disability claims can be denied for technical reasons or medical reasons. Technical reasons are things like missing forms, incomplete applications, missing deadlines, or not providing additional information as requested. A claim can be denied for medical reasons if the claims examiner doesn’t believe there is enough evidence of total disability or that the claimant is refusing to comply with the prescribed treatment. Your denial letter should include the specific reason your claim was rejected and the next steps for appealing the decision if warranted.

Can You Appeal a Claim That Has Been Denied?

You have the right to appeal an adverse decision on your case, up to and including filing a lawsuit in federal court. There are four stages of appeal for Social Security Disability benefits. The first is a reconsideration, where a different claims examiner will review your case. If that is unsuccessful, the next level is a hearing with an administrative law judge. After that, you can appeal the decision by asking for an Appeal Council review. The final stage is a federal lawsuit. There are specific rules for how long you have to appeal at every step and whether you can introduce new evidence, so it’s essential to consult an attorney as soon as possible after you receive your denial notice.

Can You Continue Working While Receiving Social Security Disability Benefits?

In some situations, it may be possible to earn a minimal income while continuing to receive disability benefits. You may also be able to attempt work on a trial basis to see if your condition has improved enough to allow you to return to full-time employment. However, it’s essential to discuss this with a disability benefits attorney before accepting a position or even doing work as an independent contractor, such as delivering groceries, as this could jeopardize your eligibility.

What Happens If Your Condition Changes?

In most cases, those who are accepted for disability benefits have chronic conditions that aren’t likely to get better, but it does sometimes happen. The Social Security Administration may conduct periodic reviews to determine if your condition has changed and if you can return to work. If your initial application was denied but your condition has worsened, it may be possible to submit another application showing that your condition has now risen to the SSA’s definition of disability.
