available to individuals in Las Vegas?
The Social Security Administration (SSA) offers two disability benefits programs, Social Security Disability Insurance (SSDI), and Supplemental Security Income (SSI).
- SSDI is available to disabled individuals between the ages of 18 and 65, regardless of their financial resources. Applicants must have paid into the Social Security system through income tax deductions, however, and have acquired a certain number of work credits, based on their age.
- SSI is only available to disabled individuals who are 65 or older or blind and who demonstrate financial need. These benefits are means tested which means an applicantās income and financial resources cannot exceed a certain threshold.
Whether you are seeking SSDI or SSI, obtaining these vital benefits is difficult — nearly two-thirds of initial claims are denied for the following reasons:
- Not having sufficient work credits (SSDI)
- Having resources above the threshold (SSI)
- Having a medical condition not considered a qualifying impairment (SSDI/SSI)
Regardless of the reasons for a denial, it takes a highly skilled disability benefits attorney to protect your rights. When you work with Roeschke Law, LLC, we will stand by you every step of the way.
Under SSA guidelines, a disability is defined as an impairment that (1) is expected to last at least one year or result in death and (2) prevents you from performing any substantial gainful activity (SGA). The SSA will also consider whether you can perform the same type of work or be retrained to perform another type of work.
In addition, the SSA maintains a list of qualifying impairments, known as the Blue Book, that disability examiners use as a guide in evaluating claims. Because it is not possible to include all the conditions that qualify as a disability, you may still be eligible even if your condition is not listed. However, a disability examiner must determine that the condition you suffer from is medically equivalent to a listed impairment.
Given the complicated eligibility requirements for obtaining Social Security disability benefits, it is crucial to have the informed representation that Roeschke Law, LLC provides. When you become our client, you will have peace of mind knowing that our experienced Las Vegas disability lawyers are in your corner.
An application for disability benefits can be submitted to the SSA field office in Las Vegas in person, by phone or online. The application process is complicated, however, and you must provide medical evidence that supports your claim. If there are errors or omissions in the application or you fail to meet the technical and medical eligibility requirements, your claim will be denied.
